Orlando Birbragher & The False Conspiracy | U.S. v/s Birbragher

A successful businessman is always caught up in one conspiracy or another set up by his competition or rival. Such is the case of Orlando Birbragher as well.

Any businessman is concentrated on the success of their venture, the change that the business brings to society. The administrative laws are seen but not understood perhaps the way they should, Orlando Birbragher a businessman was caught in the vagueness of laws and was accused of unlawful activities that were false.

Birbragher was not indicted because his business, Pharmacom, utilized the internet to distribute controlled substances. The laws of pharmacy have been stated such that pharmacy over the internet is not included and therefore, it seems unreasonable to indict any charges on Orlando Birbragher as he was operating the business and was unaware of such laws. If the issue was big it should have been notified beforehand and notice should have been sent to Birbragher which was missing in this case.

Orlando Birbragher, the defendant contends that he is unable to adequately prepare his defense while detained and would appreciate the consideration of being given a haven near his attorney for ease of case preparation.

Birbragher also points out that this is an extremely complicated and document-intensive case that requires extensive research & discussion.

It was also brought to notice by Orlando’s Attorney that the government will not permit his attorneys to remove or Photocopy some of the documents from its open discovery file; instead, Birbragher’s attorneys must take notes and then physically meet with Orlando to clarify and discuss the matter. Orlando Birbragher states that many of the documents are on compact discs (“CDs”) and need to be viewed on a computer which is difficult to acquire in a detention cell.

A very valid point was also pointed out by Orlando Birbragher — he claims that he is prejudiced by the inability to remove certain documents (“the nonremovable documents”) from the United States Attorneys’ Office wholly lacks merit, because Orlando does not have an absolute right to personally inspect or copy these documents before trial.

Before the detention, it was clearly stated and observed that Orlando Birbagher was detained without any prior notice or intimation and was not even given enough time to gather all evidence for him to dismiss the motion against him and prove his innocence.

After pointing out such validation and also giving up his passport privilege, Orlando Birbragher’s motion was denied.

However, after all these setbacks Orlando Birbragher fought and won the case, he was acquitted of all the charges and indictments upon him and is now a free United States Citizen beginning to get his business on track.
