United States v. Orlando Birbragher: Defendants Motion
If we observe the case of the USA vs. Orlando Birbragher, the defendant Orlando is accused of wrongly distributing & running his business. It is clear that the authorities have made a case not on evidence but purely on some administrative laws that are vague.

As observed Orlando Birbragher points out that the government will not permit his attorneys to remove or photocopy some of the documents from its open discovery file; instead, the attorneys must take notes and then physically meet with Orlando Birbragher. Birbragher also, states that many of the documents are on compact discs (“CDs”) and require a computer to be viewed.
Orlando points out that the Linn County, where he is being detained, the administrator of the county permits his attorney’s to bring the CDs and a computer between the hours of 1–4 pm and 6–9 pm each day. It will take a troublesome and tedious amount of time to review all case-related information in the County and will subsequently increase Orlando Bribragher’s attorney fees and not be an efficient use of time.
A very valid point was also pointed out by Orlando Birbragher — he claims that he is prejudiced by the inability to remove certain documents (“the nonremovable documents”) from the United States Attorneys’ Office wholly lacks merit, because Orlando does not have an absolute right to personally inspect or copy these documents before trial.
The defendant Orlando Birbragher files a motion and asks the court to release him to live two hours away in Des Moines, Iowa, where his lead counsel lives. Defendant states that he would agree to a number of conditions upon his release, including surrendering his Panamanian passport.

If the issue was big it should have been notified beforehand and notice should have been sent to Birbragher which was missing in this case.
Orlando Birbragher, the defendant contends that he is unable to adequately prepare his defence while detained and would appreciate the consideration of being given a haven near his attorney for ease of case preparation.
Before the detention, it was clearly stated and observed that Orlando Birbagher was detained without any prior notice or intimation and was not even given enough time to gather all evidence for him to dismiss the motion against him and prove his innocence.
After pointing out such validation and also giving up his passport privilege, Orlando Birbragher’s motion was denied.
However, after all these setbacks Orlando Birbragher fought and won the case, he was acquitted of all the charges and indictments upon him and is now a free United States Citizen beginning to get his business on track.
